Generally a settlement is conducted within 12 months after a divorce, or 2 years after a separation for a de facto marriage. It is intertwined with the child custody, child support and access decisions, as well as the disparity in incomes, the intangibles of support, the contributions to the family home, the current situation of the partners, the structure of the original marriage and what property was taken into the marriage, and what property was taken at the time of separation.
