We serve a divorce application, divorce papers, at Brisbane, and across the suburbs. There are two ways to obtain your divorce application in Australia. You may choose to attend the court house and obtain a physical copy, or you may apply online, through the Federal Magistrates court portal. If you choose an online divorce application, you may forward the PDF you receive back on to us, at the above email address, for service.
For some documents you may see a reference to a 'sealed' copy to be served. This is not referring to sealed in an envelope, the court seal, or stamp, signifies that the form has been processed by the court, and assigned a court date (usually found in a box in the top right of a front page, showing the court location and date, along with a reference number). Some international forms we serve have an embossed stamp (a raised stamp), rather than just the ink used generally in Australia. The court system is fortunately moving to more online systems, and permitting the use of electronic versions of many documents, for service. The Federal Magistrates Court is leading in the use of electronic documents.
More recently the small claims system in Queensland QCAT has started accepting some applications electronically, through its online portal. If you need electronic Queensland Magistrate, or tribunal, documents served, forward the PDFs you receive back from the court to the above email address.
The Private Group Process Servers have many years of experience serving court documents and divorce applications, local, interstate, and international court papers. We are aware of the requirements for effective service, and do multiple attempts. Our intention is to always serve at the first attempt, and rely on good instructions from the client, to assist in this. For some international court papers we are aware that there are different standards for identification, completing an affidavit of service and the swearing of the affidavit. Different legislation has different requirements for service, with some permitting substitute service, under certain conditions, at the first attempt. As Redcliffe process servers we are aware of these requirements.
As a Redcliffe process server, we are licensed in Queensland to serve court documents, court papers. We are entitled to enter a property for the purpose of serving a document, to make inquiries, to establish if the person resides at an address or when they will return if personal service is required, as process servers. There is a common law right to go up to someone's door, for this purpose. The court has an expectation that reasonable attempts at service will be made, and that if a person is avoiding service, or cannot be reasonably found, the court may instruct that we do a substitute service. Some documents can be left with another person at a residence (substitute service), for the person or entity named when initially attempting service. For some you may need a further direction from the court, prior to substitute service. This is still considered a served court document, it is a form of effective service.
